SOCIETY AND COUNTRY MUST FEEL GUILTY AND ACT AGAINST ATROCITY AGAINST ANY WOMEN
 IRRESPECTIVE OF CASTE & CLASS

Though some of you may feel bad at this time on my view. But try to understand it is a very simply understandable that all this cry is not for the girl raped in Delhi. But the place, circumstance and time are much matter. because it is very similar situation in which most of the woman of civil society, middle & elite class girls & women including most comfortable section of the society are living in Delhi. Any form of atrocity on women or girl in this situation is become direct threat the this particular section of the society. People are protesting just because of this particular section of society which is very much comfortable in the system. Otherwise lot more rapes and atrocities taking place from last fifteen days and nobody has even noticed it.

During last fifteen days
A Dalit pregnant women have been gang raped in Bhopal.
A Dalit rape victim had been killed by the rapist in the day light in Kanpur.
A Dalit girl committed suicide in Punjab.

These are just example but rapes and atrocities on rampage during this period too.

Who noticed ?

Just in the month of October around 19 Dalit women has been raped in Haryana. but the country was sleeping. If society and system will ensure freedom and dignity of the most vulnerable women in the society than each and every women of the DELHI will be automatic safe and secure.

The back ground of the Dalhi gang rape victim dose not matter at this time but the circumstances and situation has created a panic in the particular section of the society which has led discrimination among the victims.It is unfortunate that society is very selective.

LETS TREAT ALL THE VICTIMs EQUALLY !

Would like to express some more views                                                   
 (1) The police is there to keep the public safe or to  keep them  away from using their right to take up democratic processes,or is the Police  there to erode the bad or to erode the positive initiatives of the people to assert for their safety and protection. How they can hit? People who protest are emotionally charged. They have to be dealt with patience because they are not protesting to do mess but to fight the mess.

( 2) Similar protests should happen where ever such incidents happen whether the victim is Dalit or non-Dalit, with same intensity              
 (3) the service providers of our country must be trained and oriented and sensitized before they are given jobs or take up their jobs to how to handle the consumers, clients, customers, to treat the people who depend on them for their services in a dignified, respectful,courteous, helpful,transparent way ,must follow the objective way, when they perform their duties. As they are not paid to serve their personal interest or the interest of the people who have vested  interest or their personal grudges, biases, unjustified affinity,prejudices,ego,insecurities,fears,incomplete information, subjectivity,jealousies, revenge, anger, guilt,embarrassments,hiding anything that may stop from taking an objective thought and action. The same behavior is expected from the employers towards their employees and who seek their services.                                                    

 (4) Perform  duties to serve the people only because that is what they are paid for and  not to run somebody else's show           
(5) No incident is straightforward. even if it straightforward it gets complicated. Incidents are enacted also,they get complicated and and are never solved. Serious Incidents  happen  are diffused or even hijacked and used by the vested interest                                                                                  

(6) The worst that happens is when the people who don't deserve are harmed whether they may be the victims and another layer of victims who protest for these first layer of incidents and victims                                                           

 (7) The bad can be eroded and horrifying incidents can be solved, if the actual people who deserve punishments are taken to task, the laws taking care of the wrong, if at all they are fulfilling  their purpose. Laws have to be applied in the right way, to help the those who don't deserve the punishment..We are not sure if the people that are actually bad and are responsible for the wrong ever caught,                                                             

 (8) the twisted,framed ,unsupported and emotionally estranged are used and caught and face the trials and are put behind the bars.instead of given chance to get reformed  till they get prone to do wrong and can be used by others to do the wrong.                                                                                           

 (9)No doubt there are ill-feelings due to many reasons, many times they are justified also, could also be not justified. The democratic processes help in removing the ill-feelings. But the democratic processes are diffused, not only by the irresponsible and insensitive  governance but also overtaken by the messing that misleads the people even if they don't believe or understand the issue fully, people may not know all the complicated angles of the incidents.. Messing as a result of the misleading the people, creating hooligans who are used to mislead to fuel the created unjustified affinities for religion caste, class,gender,political parties, nationalities,color, race, Dalit, non-Dalit, family ties,lineage,business,rural,urban,  any basis that can lead to group ism and confrontation and make people take sides                                                              

(10) When people take sides to carry on a healthy debate to lead to solution it is  surely fine and

(11) When people take sides to mislead, just to make a talk, confuse the serious issue to ensure they get away from actual issues that demands serious attention and far from being totally objective is meanness . such a person in any capacity  is not doing justice to their job and role.                                                                                           

 (12) What process is adopted to catch the real culprit and crack the bad is most important edifice to make our country free from fear and injustice ? Instead of every time shifting to misleading issues and diffusing the actual issues?                                                                                    


 We attribute these opinions to our parents and other seniors also. This is what their experience of past life of many decades also says. We need to find the root causes, which requires the understanding of the complex past which has lead to today. Why situations go haywire even in a city like Delhi, having maximum educated people, Universities, schools,Parliament, Police next door,all national level offices, state of art technology,head quarters of all political parties,all kinds of sensitization workshops, Media,NGOs,,information exposure and many more services.  There is really something wrong and fishy !  There are many things that we need to see which we don't see and need to be found out.  There are people in our country who are not pro -India.

Rape, the Law and the Middle Class

The trauma of the Delhi woman who was raped has ended with her death. The atrocity roused middle class anger all over the country. Emotions ran high around this atrocious act of some drunken men and the demonstrators made demands such as death penalty for rape and castration in public. This outburst is understandable given the cruelty of the perpetrators of the crime. However, one can ask whether this will become one more case of reacting to a single case without taking cognizance of the malaise that leads to such crimes. It became a high profile case because it happened in Delhi. That does not reduce the atrocity of the crime. But for change to occur in favour of women one has to go beyond this single case and deal with the issues involved. One has to remember that what happened in Delhi is not an exception. It received publicity because it happened in the capital but many more cases are hushed up regularly or are not reported. According to police records during 2011 India witnessed 228,650 crimes against women, 24,206 of them of rape and 35,565 of kidnapping and abduction.

These are reported cases. Probably a much bigger number goes unreported because of the stigma attached to it. Secondly, according to police records around 90 percent of rapes are committed by persons known to the victim, most of them family members. Thirdly, a large number of victims belong to voiceless communities. For example, in an article in Counter-currents, Cynthia Stephen quotes a dalit girl from a village in Tamil Nadu as saying “ there is no girl in our lane who has not been coerced or raped by the dominant caste men when they go to the fields to fetch water or for work.” Men from the dominant castes threaten the dalits with dire consequences if they dare complain to the police. So these cases go unreported. Finally, often the police add to the trauma. For example, an 18 year old girl in Badhshapur village in Patiala committed suicide on December 26, six weeks after being raped by three men. Her mother reports that when she went to complain to the police they humiliated the girl with lewd question such as “how did they touch your breast? Did they open their jeans or coat first?” The criminals were arrested only after her suicide. Or take the case of the police officer in Haryana who was elevated to the highest rank though a budding tennis star had accused him of raping her. She too committed suicide because she was unable to bear the harassment. The officer was given a six month jail sentence some years after his retirement.

These and other cases are symbolic of the attitudes of our society. The middle class stages demonstration in high profile cases and ignores the rest. Also the so called national media do the same. For example, when on December 23, 2005 some university students got into a railway compartment at Kokrajhar not knowing that it was a military wagon. All of them were raped by men paid to protect the citizens. But it did not become national news. Even in Assam it remained a Bodo women’s issue, not of all women. In other words, crimes against women are a result of the strong patriarchal values of our society but are also conditioned by ethnic and caste attitudes and in many cases by a false sense of patriotism. For example when the security forces rape women people are told to protect their honour and not report those cases. The victims do not matter. Even laws such as the Armed Forces Special Powers Act protect such criminals in uniform.

Given these attitudes, one can ask whether new laws, even death penalty, can prevent such crimes. One does not deny that police reforms and strong laws are required. But they alone cannot solve the problems that are deep rooted in our culture which is visible in actions such as a few lakh female foetuses aborted every year because women are considered a burden. If all rapists were to be hanged, the victims would have to lose some of their family members who are perpetrators of these crimes. Moreover, the acceptance of the value of male superiority by most women ensures that abuses are kept secret often on the pretext of protecting the girl’s or family honour. Or take the case of the tribal customary laws in the North East that give all social power to men alone. The leaders refuse to change the laws. For example, Nagaland has not been able to hold elections to the municipal councils because of the tribal leaders’ opposition to 33 percent reservations for women. They claim that their customary law does not allow women to have political power.

It is clear then, that laws cannot change this system. Dowry, child labour, caste-based discrimination are banned by law. But they cannot be implemented without changing the attitudes that give birth to these abuses. It is as true about women’s status as about corruption, caste and ethnic attitudes. No law can become effective without a social infrastructure to support it. But the temptation of the middle class that leads the demonstrations against rape, corruption and other abuses is to take up an event in isolation and ignore the attitudes and the social systems that cause it. For example, this class rightly took up political corruption as a cause to fight against but very few of them asked whether the hands of those who protested are clean. Similarly, this class also protested against the unjust arrest and jailing of Dr Binayak Sen and that was required. But they did not question the Sedition Act or the middle class needs for which the tribals are displaced. Their impoverishment is at the root of the Maoist rebellion in Central India.

One needs to ensure that also the issue of rape does not end with one case. The gender, class and caste attitudes that cause such abuses have to be tackled. One cannot stop at condemning the politician and the police departments. That step is required but new laws can only give one peace of conscience and cannot solve the problem. One has to look inwards and examine the social and cultural values that are behind such crimes. If the Delhi rape case leads to such self-examination, the 23 year old para-medical will not have laid down her life in vain.

मानवाधिकार दिवस (10 दिसम्बर) हमारे लिए एक मौका होता है भारत में मानवाधिकारों की स्थिति का अध्ययन करने का। मानवाधिकारों की अवधारणा, प्रजातांत्रिक सिद्धांतों पर आधारित है। पिछले कई दशकों से, विशेषकर संयुक्त राष्ट्रसंघ के अस्तित्व में आने के बाद से, मानवाधिकारों को दुनिया भर में महत्व दिया जाने लगा है। संयुक्त राष्ट्रसंघ के जरिए, दुनिया के विभिन्न देशों के निवासियों के मानवाधिकार क्या होने चाहिए और वे उन्हें उपलब्ध हों, यह कैसे सुनिश्चित किया जाए आदि जैसे प्रश्नों पर गहराई से विचारमंथन होता आ रहा है। कई देशों, जिनमें भारत शामिल है, ने संयुक्त राष्ट्रष्संघ द्वारा जारी किए गए मानवाधिकार घोषणापत्रों पर हस्ताक्षर किए हैं। भारत के इन घोषणापत्रों के हस्ताक्षारकर्ता होने के बावजूद यहां अल्पसंख्यकों के मानवाधिकारों की स्थिति वैसी नहीं है, जैसी कि होनी चाहिए। यह साफ है कि किसी भी देश में प्रजातंत्र की सफलता का एक मानक यह है कि वहां अल्पसंख्यकों-विशेषकर धार्मिक अलपसंख्यकों-और समाज के अन्य कमजोर वर्गों को कितने मानवाधिकार प्राप्त हैं। इस पैमाने पर भारत बहुत पीछे है।
अल्पसंख्यकों के मानवाधिकारों के उल्लंघन के मूल में है बढ़ती साम्प्रदायिक हिंसा और हमारी राजनीति में साम्प्रदायिकता की घुसपैठ। साम्प्रदायिक हिंसा में विश्वास करने वाले तत्व हमारे समाज के विभिन्न तबकों में घर कर गए हैं और इनके कारण अलगाववादी प्रवृत्तियों में बढ़ोत्तरी हुई है। इससे, अंततः, धार्मिक अल्पसंख्यकों के मानवाधिकारों का उल्लंघन हो रहा है। ये सभी प्रक्रियाएं ऐसी हैं जो कि एक-दूसरे को मजबूती देती हैं।
चूंकि साम्प्रदायिक हिंसा, साम्प्रदायिक राजनीति का सबसे दृष्टव्य हिस्सा है इसलिए सबसे पहले हमारा ध्यान उस ओर जाना स्वाभाविक है। पिछले 60 वर्षों में साम्प्रदायिक हिंसा में बढ़ोत्तरी हुई है और सन् 1980 के दशक में पहचान से जुड़े मुद्दों के जोर पकड़ने के साथ ही, साम्प्रदायिक दंगों की ज्वाला की लपटें भी और ऊँची उठने लगी हैं। शाहबानो कांड ने साम्प्रदायिक तत्वों को अपने हाथपैर फैलाने का मौका दिया और इससे ही शुरू हुई पहचान पर आधारित राजनीति। राम मंदिर का मुद्दा, साम्प्रदायिक तत्वों को एक मंच पर लाने में सफल रहा। इसके बाद से साम्प्रदायिक हिंसा में भयावह वृद्धि हुई।
इस हिंसा के शुरूआती शिकार थे मुस्लिम अल्पसंख्यक। परंतु बाद में ईसाईयों को भी निशाने पर ले लिया गया। साम्प्रदायिक हिंसा का मूल चरित्र मुस्लिम विरोधी है, यह इस तथ्य से स्पष्ट है कि साम्प्रदायिक हिंसा, जो कि आजाद भारत में सन् 1961 में जबलपुर से शुरू हुई थी, से लेकर हाल में उत्तरप्रदेश के कुछ इलाकों में हुए दंगों तक, हिंसा में जान गंवाने वालों में से 90 प्रतिशत मुसलमान होते हैं। सन् 2001 की जनगणना के अनुसार, कुल आबादी में उनका प्रतिशत 13.4 है। जहां तक ईसाई-विरोधी हिंसा का सवाल है, उसने जोर पकड़ा सन् 1990 के दशक में। सन् 1999 में पास्टर ग्राहम स्टेन्स की हत्या और सन् 2008 में कंधमाल में आदिवासियों पर हमले हुए।
हिंसा अकेले नहीं आती। उसके आगे-आगे चलती हैं निशाना बनाए गए समुदाय के दानवीकरण की प्रक्रिया। साम्प्रदायिक हिंसा इसलिए संभव हो पाती है क्योंकि साम्प्रदायिक ताकतें और पुलिसबल व राज्यतंत्र जुगलबंदी में काम करते हैं। प्रशासनतंत्र और पुलिस का पूरी तरह साम्प्रदायिकीकरण हो चुका है। साम्प्रदायिक हिंसा के पीछे आती है साम्प्रदायिक ध्रुवीकरण की प्रक्रिया। यह भी साम्प्रदायिक राजनीति को और मजबूती देती है। धार्मिक आधार पर ध्रुवीकरण से धार्मिक अल्पसंख्यक अपने-अपने मोहल्लों में सिमट जाते हैं और इससे उनकी आर्थिक स्थिति में और गिरावट आती है। देश के लगभग सभी बड़े शहरों में ध्रुवीकरण की प्रक्रिया जारी है और दिन-प्रतिदिन तेज होती जा रही है। इसने मुस्लिम अल्पसंख्यकों की माली हालत पर बहुत विपरीत प्रभाव डाला है। यदि हम एक मानवाधिकार सूचकांक की कल्पना करें, तो उसमें शामिल होंगे संबंधित समुदाय में सुरक्षा की भावना और उसके साथ बराबरी का व्यवहार। समुदाय में रोजगार और आवश्यक आर्थिक-सामाजिक सुविधाओं की उपलब्धता की स्थिति का भी हमें ध्यान रखना होगा।
जहां तक मुस्लिम समुदाय का सवाल है, उस पर लदा हुआ एक ऐतिहासिक बोझ भी उसके आर्थिक विकास के रास्ते में रोड़ा है। मुसलमानों की आर्थिक बेहतरी के लिए कोई सकारात्मक कदम न उठाए जाने के कारण वे आर्थिक क्षेत्र में हाशिए पर पटक दिए गए हैं और धीरे-धीरे पीछे, और पीछे छूटते जा रहे हैं। यह सर्वज्ञात है कि भारत के विभाजन के समय जिन मुसलमानों ने भारत में रहना तय किया उनमें से अधिकांश निचले सामाजिक-आर्थिक तबके के थे। उनकी समस्या को और बढ़ाया बहुसंख्यक समुदाय द्वारा उन्हें नीची निगाहों से देखने की प्रवृत्ति ने। उन्हें विभाजन के लिए जिम्मेदार माना जाता था। रोजगार और आर्थिक अवसरों की उपलब्धता की दृष्टि से उन्हें समाज में उनका उचित स्थान नहीं मिला। वे मंझधार में ही छूट गए। इसके अतिरिक्त, वे साम्प्रदायिक हिंसा का भी निशाना बने और अंततः लक्ष्यविहीन हो भटकने लगे। राजनैतिक पार्टियों ने उनकी हालत को नजरअंदाज किया और उनके अपने समुदाय के नेता नाकारा साबित हुए।
मुसलमानों की हालत कितनी खराब है यह सच्चर समिति और रंगनाथ मिश्र आयोग की रपटों से पता चलता है। ये रपटें हमें बताती हैं कि विभिन्न आर्थिक सूचकांकों पर मुसलमानों की स्थिति में तेजी से गिरावट आई है। यह सब मुस्लिम अल्पसंख्यकों के मानवाधिकारों का उल्लंघन है। इस समुदाय के लोगों को अपने भविष्य से जरा भी आशा नहीं रह गई है और यही कारण है कि उन्हें शिक्षा प्राप्त करने के लिए प्रेरित करना बहुत कठिन हो गया है। उन्हें लगता है कि वे कुछ भी कर लें, उनकी हालत में कोई सुधार  नहीं आएगा। इन परिस्थितियों यह आवश्यक है कि राज्य उनकी बेहतरी के लिए सकारात्मक कदम उठाए ताकि वे अपने मानवाधिकार हासिल करने की दिशा में आगे बढ़ सकें। जब भी कोई समुदाय अपने आप में सिमटने लगता है तब आवश्यक रूप से उसमें संकीर्ण सोच और दकियानूसीपन बढ़ता है। बढ़ता दकियानूसीपन, साम्प्रदायिक तनाव, अलगाव के भाव और साम्प्रदायिक हिंसा को और बढ़ाता है। अगर इस दुष्चक्र को तोड़ना है तो सबसे पहले यह सुनिश्चित किया जाना जरूरी है कि किसी भी स्थिति में साम्प्रदायिक हिंसा न हो। इस संदर्भ में साम्प्रदायिक हिंसा निरोधक कानून और राज्य व सामाजिक संगठनों द्वारा इस समुदाय के विरूद्ध चलाए जा रहे दुष्प्रचार का मुकाबला किया जाना अत्यंत महत्वपूर्ण है।
जब तक कोई व्यक्ति या समुदाय, भौतिक रूप से स्वयं को सुरक्षित अनुभव नहीं करता, तब तक उसकी प्रगति या समृद्धि की कोई संभावना नहीं है। भौतिक सुरक्षा, देश के प्रत्येक नागरिक का प्रजातांत्रिक व मानव अधिकार है। धर्म-आधारित राष्ट्रवाद की विचारधारा के उदय से कई स्थानों पर मुसलमानों को द्वितीय श्रेणी का नागरिक बना दिया गया है। इस स्थिति का एक उदाहरण है गुजरात। मध्यप्रदेश जैसे राज्यों में सरकारी नीतियों और कार्यक्रमों के जरिए मुस्लिम समुदाय पर एक संस्कृति विषेष लादी जा रही है और उन्हें सांस्कृतिक, शैक्षणिक व आर्थिक क्षेत्रों से खदेड़ा जा रहा है।
यह स्पष्ट है कि धर्म से शक्ति ग्रहण करने वाली इस राजनीति के खिलाफ लड़ने और भारतीय संविधान के मूल्यों को पुनर्स्थापित किए जाने की जरूरत है। मुस्लिम अल्पसंख्यकों को भी यह सुनिश्चित करना होगा कि उनके दकियानूसी व कट्टरपंथी तत्वों को नियंत्रण में रखा जाए और समुदाय के सदस्य उन सामाजिक आंदोलनों का साथ दें जो धर्मनिरपेक्ष-प्रजातांत्रिक मूल्यों के लिए लड़ रहे हैं। यही मुसलमानों के लिए मानवाधिकार हासिल करने की सबसे अच्छी राह होगी। (मूल अंग्रेजी से हिन्दी रूपांतरण अमरीश हरदेनिया)  (लेखक आई.आई.टी. मुंबई में पढ़ाते थे और सन् 2007 के नेशनल कम्यूनल हार्मोनी एवार्ड से सम्मानित हैं।)

कुछ प्रमुख समाचारपत्रों (16 दिसम्बर 2012) में अंदर के पृष्ठों पर यह खबर थी कि राष्ट्रीय जांच एजेन्सी (एनआईए) ने मध्यप्रदेश के उज्जैन शहर के नजदीक से समझौता एक्सप्रेस धमाके के तीसरे बाम्बर राजेन्द्र चौधरी को गिरफ्तार कर लिया है। एनआईए द्वारा दायर किए गए पूरक आरोपपत्र में चौधरी को इस बम धमाके के प्रमुख आरोपियों में से एक बताया गया है। समझौता एक्सप्रेस में सन् 2007 में हुए धमाके में 68 लोग मारे गए थे जिनमें से 43 पाकिस्तानी थे। जांच में पता चला कि ब्रीफकेसों में बंद विस्फोटक सामग्री, चार विभिन्न लोगों ने, ट्रेन में अलग-अलग स्थानों पर रखी थी। ये लोग आरएसएस प्रचारक सुनील जोशी, संदीप डांगे और रामचन्द्र कालसांगरा के निर्देशों पर काम कर रहे थे। इनमें से सुनील जोशी की बाद में हत्या हो गई। भगवा आतंकी शिविर के कई सदस्य पहले ही सींखचों के पीछे हैं। इनमें शामिल हैं स्वामी असीमानंद और उनके साथी। इन लोगों ने मक्का मस्जिद, मालेगांव और अजमेर आदि में मुस्लिम धार्मिकस्थलों पर या उनके नजदीक, ऐसे मौकों पर विस्फोट किए जब वहां बड़ी संख्या में मुसलमान इकट्ठा थे। जाहिर है, उनका इरादा अधिक से अधिक संख्या में मुसलमानों को मारना था।
इस खबर के बारे में एक अत्यंत चौंकाने वाली बात है मीडिया द्वारा इसे बहुत कम महत्व दिया जाना। अधिकतर बड़े अखबारों ने तो इसे पहले पृष्ठ पर छापने लायक भी नहीं समझा। हम सबको याद है कि जब इन्हीं बम विस्फोटों के लिए निर्दोष मुस्लिम युवकों को जिम्मेदार बताकर गिरफ्तार किया गया था तब अखबारों ने 8-8 कालमों की बैनर हेडलाईनें छापीं थीं। जहां तक हिन्दी मीडिया का सवाल है, उसने इस खबर में सभी जरूरी मसाले मिलाकर इसे चटपटा बनाने का पूरा प्रयास किया था। सारा जोर तथाकथित आरोपियों के धर्म पर था। इसके बाद, अदालतों के निर्णय आए, जिनमें इन युवकों को निर्दोष बताकर बरी कर दिया गया। ये खबरें भी अखबारों को बहुत महत्वपूर्ण नहीं लगीं और अधिकतर ने इन्हें छठवें या सातवें पेज पर सिंगल कालम में जगह दी। मीडिया के इन दुहरे मानदंडों से यह साफ है कि हमारे देश के बड़े अखबारों के संपादक और पत्रकार पूर्वाग्रहों से ग्रस्त हैं, विशेषकर जब मामला साम्प्रदायिक या आतंकी हिंसा का हो। यह दुर्भाग्यपूर्ण है कि मीडिया विशेषज्ञों और टीकाकारों ने इस पूर्वाग्रह को हमेशा नजरअंदाज किया। साम्प्रदायिक हिंसा के मामलों में मीडिया, या तो पुलिस के और या फिर समाज के प्रभुत्वशाली वर्ग के घटनाक्रम के विवरण को बिना कोई प्रश्न पूछे या शंका जताए स्वीकार कर लेता है। आतंकी हिंसा के मामले में मीडिया रपटों की भाषा एवं शैली से यह स्पष्ट झलकता है कि इन रपटों को लिखने और संपादित करने वालों का यह अटूट विश्वास है कि सभी आतंकवादी मुसलमान होते हैं।
साम्प्रदायिक और आतंकी हिंसा के मामले में पुलिस का दृष्टिकोण भी यही रहता है। हर आतंकी हमले के बाद, मुस्लिम युवकों को जेल में ठूंस दिया जाना आम था और यह सिलसिला तब तक जारी रहा जब तक कि मालेगांव धमाकों और पूर्व अभाविप कार्यकर्ता साध्वी प्रज्ञा सिंह ठाकुर की मोटरसाईकिल के बीच के संबंध के सुबूत हेमन्त करकरे ने नहीं खोज निकाले। तब तक महाराष्ट्र के आतंकवाद निरोधक दस्ते के प्रमुख इन धमाकों के उन संदेहियों को पूरी तरह नजरअंदाज करते आ रहे थे जो संघ या उसकी विचारधारा से जुड़े थे। अप्रैल 2006 में आरएसएस कार्यकर्ता राजकोंडवार के महाराष्ट्र के नांदेड़ स्थित निवास पर बम विस्फोट हुआ था। मकान पर बजरंग दल का बोर्ड टंगा हुआ था और छत पर भगवा झंडा लहरा रहा था। जांच को आगे बढ़ाने के पर्याप्त कारण थे और अगर ऐसा किया गया होता तो जो लोग इस समय जेल में हैं, वे उसी समय पकड़ लिए जाते और सैकड़ों निर्दोषों की जान बच जाती।  परंतु चूंकि पुलिस के अधिकारियों ने सुबूतों की बजाए अपने पूर्वाग्रहों पर ज्यादा भरोसा किया इसलिए जांच आधी-अधूरी छूट गई और अपराधी एक के बाद एक विस्फोट करते रहे। पुलिस अधिकारियों के लिए किसी हिन्दू को आतंकी हमले के लिए गिरफ्तार करना न सोचे जा सकने वाला विचारथा। पुलिस और मीडिया दोनों ने सोचे जा सकने वाले विचारको तरजीह दी और मुसलमानों को खलनायक निरूपित किया जाता रहा।
जब हेमन्त करकरे ने यह तय किया कि वे समाज में प्रचलित मान्यताओं पर नहीं बल्कि पुलिस अफसर के बतौर उन्हें दिए गए प्रशिक्षण के आधार पर काम करेंगे तो उनके रास्ते में बहुत से कांटे बिछा दिए गए। उन्हें राजनैतिक दबाव का सामना भी करना पड़ा। बाल ठाकरे ने सामनामें लिखा कि हम हेमन्त करकरे के मुंह पर थूकते हैं और नरेन्द्र मोदी ने करकरे को देशद्रोही बताया। हेमन्त करकरे की मौत से इस जांच को गहरा धक्का लगा परंतु करकरे ने एक नई दिशा में सोचने की जो राह खोल दी थी वह बंद नहीं हुई। न सोचा जा सकने वाला विचार‘, ‘सोचा जा सकने वाला विचारबन गया।
स्वामी असीमानंद के मजिस्ट्रेट के सामने दिए गए इकबालिया बयान, जिससे वे बाद में पीछे हट गए, से कई ऐसे सुबूत सामने आए जिनकी सूक्ष्म जांच से राजस्थान एटीएस, एनआईए व अन्य जांच एजेन्सियां सच तक पहुंचने में सफल हुईं।
जिस समय मुस्लिम युवकों को बिना सोचे-समझे गिरफ्तार किया जा रहा था तब कई सामाजिक कार्यकर्ताओं ने सरकार और जांच एजेन्सियों का ध्यान इस ओर आकर्षित करने की कोशिश की थी कि असली दोषियों को नजरअंदाज कर निर्दोषों को फंसाया जा रहा है परंतु उनकी आवाज नक्कारखाने में तूती साबित हुई। एक जनन्यायाधिकरण ने बलि के बकरे और पवित्र गाएंशीर्षक से अपनी रपट में जनता और राज्यतंत्र को बम विस्फोटों की त्रासद सच्चाई से अवगत कराने की कोशिश की थी। इस रपट में यह बताया गया था कि असली अपराधियों को उनकी कार्यवाहियां जारी रखने के लिए स्वतंत्र छोड़ा जा रहा है और मासूमों को जेलों में डाला जा रहा है। कहने की आवश्यकता नहीं कि इन गिरफ्तारियों से निर्दोष मुस्लिम युवकों के कैरियर और जिंदगियां बर्बाद हो गईं। आज भी बाटला हाऊस मुठभेड़ और आजमगढ़ के युवकों की आतंकी हमलों में तथाकथित भागीदारी के संबंध में कई प्रश्नचिन्ह लगे हुए हैं। कुछ राजनीतिज्ञों ने यह मुद्दा उठाया भी परंतु अब तक तो हमारी सरकारें उन मुस्लिम युवकों और उनके परिवारों के दुःखों के प्रति अपनी आखें मूंदे हुए हैं जिन्हें जबरन आतंकी घोषित कर दिया गया था। एनआईए द्वारा की जा रही सूक्ष्म जांच से कुछ आशा अवश्य जागी है कि असली दोषी पकड़े जाएंगे और उन्हें अदालतों से सजा मिलेगी।
काफी देर से ही सही, परंतु रामविलास पासवान के नेतृत्व में एक प्रतिनिधिमंडल ने प्रधानमंत्री से मुलाकात कर इस मुद्दे पर एक ज्ञापन सौंपा। प्रधानमंत्री ने वायदा किया कि सरकार यह सुनिश्चित करेगी कि निर्दोष युवकों की गिरफ्तारियों का सिलसिला बंद हो, उन्हें न्याय मिले और उनका पुनर्वसन हो।प्रधानमंत्री ने यह आश्वासन भी दिया कि वे इस मामले में गृहमंत्री से बात करेंगे। हम नहीं जानते कि सरकार उन निर्दोष युवकों को हुए नुकसान की भरपाई कैसे करेगी जिन्होंने असंवेदनशील तंत्र के हाथों घोर कष्ट भोगे। क्या सरकार बाटला हाऊस मुठभेड़ की निष्पक्ष जांच करवाने का साहस दिखाएगी, ताकि सच सामने आ सके?
यह न मानने का कोई कारण नहीं है कि यदि नांदेड़ धमाके, जिसमें बजरंग दल के कार्यकर्ता बम बनाने के प्रयास में मारे गए थे, की तार्किक जांच हुई होती तो बाद में हुए कई धमाके रोके जा सकते थे। यह केवल एक कयास है परंतु ऐसा होता, इसकी काफी संभावना है। क्या हमारा तंत्र इससे सही सबक सीखेगा और अधिक निष्पक्ष जांच प्रक्रिया अपनाएगा?
पिछले एक दशक में भारत में कई आतंकी हमले हुए हैं। इनकी सूची काफी लंबी है। इनमें शामिल हैं नांदेड़, मालेगांव, मक्का मस्जिद, समझौता एक्सप्रेस आदि। क्या इनके लिए मिथ्या आधारों पर फंसाए गए निर्दोषों को न्याय मिलेगा?       (मूल अंग्रेजी से हिन्दी रूपांतरण अमरीश हरदेनिया) (लेखक आई.आई.टी. मुंबई में पढ़ाते थे और सन् 2007 के नेशनल कम्यूनल हार्मोनी एवार्ड से सम्मानित हैं।)
