I want to draw your attention on an incident of grueling torture upon a person from Schedule Caste community. Mr. Ranjan Mondal, aged about 40 years, son of Mr. Rishipada Mondal, resident of village- Char Sahebnagar, Post Office- Border Para, Police Station- Raninagar, District- Murshidabad is living with his family comprising of wife and two minor sons. The person lost all his agrarian lands and became an agrarian wage labourer. The area and its populace have faced subsequent spates of river erosion and floods from river Padma making the commoners paupers and in the brink of hunger. The pathetic situation further aggravated by the insensitivity shown by the duty bearers by not extending the state run schemes (BPL card, 100 days' work, etc.) on rural employment and other related programme.
On 15.12.2012 the victim left his home at about 5.30 am in search of work. He reached at the south side of 'Iron Bridge' of Kaharpara at about 6.00 am. While he was on his way, all of a sudden 5 Border Security Force Jawans of Kaharpara BSF Out Post No. 5 of 105 Battalion of BSF on their camouflage uniform, restricted his movement. He was seized by the said BSF personnel and pined down to earth. The BSF personnel out of a blue started beating him with riffle butts and sticks using slangs, which they were holding at that time. They started kicking Ranjan with boot clad feet while he fell down at the ground. During this inhumane bashing the BSF personnel tied the hands of Ranjan at his back. The wife of the victim; Ms. Sadhna Mondal rushed to the place while informed by few villagers who witnessed torture upon her husband. Mr. Indrajit Mondal; son of Mr. Krishna Chandra Mondal of Char Durgapur, Ms. Kalpana Mondal; wife of Mr. Sadhu Mondal of Char Sahebnagar and Mr. Kalu Seikh; son of Mr. Chand Mohammad of Char Bansgora all under Post Office- Harudanga and Police Station- Raninagar witnessed the torture. The wife of the victim Ms. Sadhana Mondal and Ms. Kalpana Mondal while tried to rescue Mr. Ranjan Mondal, the BSF personnel made verbal abuses with sexual connotation. The BSF personnel warned the women by saying that we would shove the sticks on your private parts. Later, the BSF personnel cautioned the wife of the victim, not to make any complain at police station and if not obeyed; they will beat all the family members to death. The family members and neighbors took Ranjan Mondal to a nearby doctor. Due to their poor financial situation the victim failed to receive proper and adequate medical care. In a process Mr. Ranjan Mondal became crippled due to the torment and lost his ability to work which further worsen the financial situation of the family.
The frightened victim and his family somehow manage the courage to make a complaint before the police and in this respect sent a complaint to the Superintendent of Police of Murshidabad on 03.04.2012 but no recourse measures has been taken.
The medical team of "VIC-TREE", a project run by us (MASUM) with support of UNVFVT, gave him and his family medical support and also we recorded his statement. Please look into -
In this regard I demand for:
- A thorough investigation of the incident by an independent agency
- Errant BSF personnel booked with specific charges for causing grievous hurt to a person and making obscene remarks and challenging modesty of women
- Financial compensation for his monetary loss encountered by absence in daily wage earning due to received injuries and medical expenses incurred in past suppose medical expenses for his treatment in future
- Complete security and protection for the victim, his family and witnesses
