HRD, senior citizen threatened by police

9th November 2011

To
The Chairman
National Human Rights Commission
Faridkot House
Copernicus Marg
New Delhi-110001

Respected Sir,

We have received information that Mr. Shyamal Roy, son of Late Sukhendu Bhusan Roy, aged about-70 years, residing at New Garia, Post – Dhalua, Kolkata-700152 was criminally intimidated by two police personnel on 5.11.2011 at noon. At that time he was inside his house when he heard that two men in civil dress were searching for him by calling his name in front of his house. Then he welcomed the said two men inside his house and after some conversation he wanted to know their actual particulars. One man disclosed that he was Mr. Tapan Roy being Sub-Inspector of Police at Sonarpur Police Station and the other man disclosed that he was Mr. A.K. Mondal being Assistant Sub-Inspector of Police of the same police station. The said two policemen told Mr. Shyamal Roy that they came to seize his mobile ‘SIM’ card of Tata Docomo connection (being no. 8961002530). The police personnel did not disclose any reason for seizing the said SIM Card. Mr. Shyamal Roy handed over the said SIM Card to them but the said police personnel did not issue any seizure memo against seizure of the said SIM Card. Then the said policemen further wanted to seize other items from the possession of Mr. Shyamal Roy but he protested and told them to bring legal order from the court in order seize items from his house. Then the said policemen called the Officer-in-Charge of Sonarpur Police Station and after the conversation with the Officer-in-Charge, the said policemen left the house telling that they would come again.

Mr. Shyamal Roy is a homeopath doctor and also a human rights defender. In the year 2010 he established an organisation named “Dadhichi” aimed at working with the rights of women, education and state atrocities.  Sometimes he used to send SMS to people in connection on the incidents of violation of rights only intended to make them aware.

We strongly condemn the incident where two police personnel completely being in civil dress intruded into the house of Mr. Shyamal Roy with definite intention to seize some items. The police personnel did not issue any memo for seizing the SIM Card from Mr. Shyamal Roy and the reason for seizing the same is still completely unknown. Moreover Mr. Shyamal Roy is still not facing any charge using the said SIM Card.

We strongly apprehend that Mr. Shyamal Roy has already become a victim of a grave conspiracy of state and its agencies and his life and liberty is under threat. This is so because Mr. Shyamal Roy might have already become eyesore of the state for his activism as a human rights defender.

Hence we seek your urgent intervention in this matter and we demand that a neutral enquiry must be directed in this matter and the perpetrator police personnel must be booked for acting illegally and contrary to the provisions of law. We also demand that the life and liberty of Mr. Shyamal Roy being a human rights defender must be protected and any type illegal intrusion into his life and liberty must be stopped immediately.

We are eagerly waiting for your urgent action in this matter.

Thanking You,
Yours truly,

Kirity Roy
